General Terms and Conditions of Sale
1. General provisions
These terms and conditions are valid exclusively between Exclusive Lash & Brow SRL, with registered office in Via Vicenza, 5, 36033 Isola Vicentina (VI)
and any natural or legal person who makes online purchases on the website www.mylamination.com, hereinafter referred to as the ‘CUSTOMER’. These terms and conditions are subject to change, and the date of publication online is equivalent to the date of entry into force.
These general terms and conditions govern purchases made on the website www.mylamination.com, in accordance with Articles 50 et seq. of Legislative Decree No. 206 of 6 September 2005, Consumer Code, Section II of Chapter I of Title III of Part III, to which reference is made as provided for in Article 60 of the Consumer Code.
1.1 The Customer shall have no right to compensation for damages or indemnity, nor shall there be any contractual or extra-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance, even partial, of an order.
2. Subject of the Contract
Under these general terms and conditions of sale, Exclusive Lash & Brow SRL sells and the CUSTOMER purchases remotely the tangible movable goods indicated and offered for sale on the website www.mylamination.com. The contract is concluded exclusively via the internet, through the CUSTOMER accessing the website www.mylamination.com and completing and finalising a purchase order in accordance with the procedure set out on the website itself and in these general terms and conditions of sale.
3. Conclusion and Effectiveness of the Contract
3.1 The sale shall be considered concluded when Exclusive Lash & Brow SRL sends the Client an order confirmation e-mail and once payment has been successfully registered. The e-mail contains the CLIENT's details and order information, the price of the purchased goods, shipping costs, and the delivery address to which the goods will be sent. The CLIENT undertakes to verify the accuracy of the data contained therein and to promptly communicate any corrections.
3.2 Exclusive Lash & Brow SRL undertakes to describe and present the items sold on the website in the best way possible. Nonetheless, some errors, inaccuracies, or slight differences between the website and the actual product may occur. Furthermore, the product photographs displayed on www.mylamination.com do not constitute a contractual element, as they are merely representative.
4. Availability of Products
4.1 Product availability refers to the stock present at the moment the CLIENT consults the product pages; however, this must be considered purely indicative because, due to the simultaneous presence of multiple users on the website, products may be sold to others before the order is confirmed.
4.2 Even after Exclusive Lash & Brow SRL has sent the order confirmation e-mail, cases of partial or total unavailability of the goods may occur. In such an event, the CLIENT will be promptly informed and may decide whether to accept delivery of the available products only or request the cancellation of the order by notifying customer service via e-mail.
5. Methods of Payment
5.1 All payments by the CLIENT may be made exclusively by PayPal (3.4% fees paid directly to PayPal and not invoiced by us), Klarna (2.49% + €0.35 per transaction fee paid by us and not invoiced; minimum cart €35, maximum cart €2,000), or bank transfer (shipping after the payment has been credited). For payments made by bank transfer, if a product becomes unavailable after the order is registered and the amount is reserved on the card, Exclusive Lash & Brow SRL will take the necessary steps with the payment operator to reverse the transaction related to the unavailable goods.
5.2 Communications relating to payment and the data provided by the CLIENT at the time the payment is made take place over secure, dedicated lines and with all guarantees ensured by the security protocols required by the payment circuits.
6. Prices
6.1 All sale prices of the products displayed and indicated on the website www.mylamination.com are expressed in Euro.
6.2 Shipping costs are not included in the purchase price but are indicated and calculated at the end of the purchase process before payment is completed.
Shipping cost: €9.90.
Free shipping on orders over €150.
6.3 Exclusive Lash & Brow SRL reserves the right at any time to send a free gift different from the one indicated in the cart, but still of equal or greater value. Requests from customers for substitutions, changes, or returns of the free gift will not be considered. The free gift is not guaranteed when promotions above 35% are active on the website.
6.4 The CLIENT accepts the right of Exclusive Lash & Brow SRL to modify its prices at any time; however, the goods will be invoiced based on the prices indicated on the website at the time of the order and confirmed in the e-mail sent by Exclusive Lash & Brow SRL as confirmation of the order.
7. Right of Withdrawal
7.1 In accordance with current legal provisions, the CLIENT has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 calendar days as provided by law (Legislative Decree No. 206/2005), starting from the date of delivery of the products.
7.2 If the CLIENT decides to exercise this right, they must request it via e-mail to customer service at international@mylamination.com . The goods must be returned using a tracked parcel to Exclusive Lash & Brow SRL, Via Vicenza, 5, 36033 Isola Vicentina (VI). By law, the return shipping costs are borne by the CLIENT. The goods must be returned intact, in the original packaging, complete in all their parts (including packaging and any documentation or accessories: manuals, cables, etc.), and accompanied by the attached tax documentation. Subject to verification of compliance with the above conditions, Exclusive Lash & Brow SRL will refund the amount of the products covered by the withdrawal as soon as possible using the same payment method used for the purchase, and in any case within a maximum of 14 days, pursuant to Legislative Decree 21/2014 implementing Directive 2011/83/EU on consumer rights, in force since 14/06/2014.
7.3 If the CLIENT receives products that do not conform to the order or are defective, they must notify customer service at international@mylamination.com within 15 days from discovering the defect. The client must then return the intact goods at their own expense to the address provided by the seller.
8. Product Warranty
All products presented on the website www.mylamination.com come with a contractual warranty, the duration of which is indicated on the product sheets, and in any case with a legal warranty of 24 months for defects of conformity, in accordance with current regulations, provided that the products are intact, used correctly, and stored according to the instructions, within the limits of their natural lifespan. To use the warranty service, the CLIENT must keep the invoice, which can be printed through the “My Orders” section after the order has been shipped.
9. Transport and Delivery
Shipments are carried out by FEDEX express courier to the address indicated by the CLIENT.
Orders received on working days before 1:30 PM are processed and shipped the same day, except for those paid by bank transfer, which will be shipped only after the payment has been credited.
Telephone pre-notification is not available.
10. Liability
10.1 Exclusive Lash & Brow SRL assumes no responsibility for disruptions due to force majeure or unforeseeable events, including malfunctions or failures of the Internet network, in cases where it cannot execute the order within the timeframes set by the contract. Likewise, Exclusive Lash & Brow SRL shall not be liable for direct or indirect damages resulting from delays in the delivery of the order when caused by third parties.
10.2 Product availability is purely indicative, is not contractual, and no responsibility can be attributed to the seller in case one or more products become unavailable.
11. Access to the Website
11.1 The CLIENT has the right to access the website for consultation and for making purchases. No other use of the site or its content is permitted, especially commercial use. All elements of this site, whether audio or visual, and the related technology remain the property of Exclusive Lash & Brow SRL and are protected by intellectual property rights.
11.2 Professional-use products may only be used by individuals experienced in the field of lifting (lamination), professional beauticians experienced in lifting, who have also completed the specific training courses provided by Exclusive Lash & Brow SRL, My Lamination, and My Lamination Brow. Any use different from the above, or carried out by non-professionals, or by individuals without specific knowledge in the field, or who have not attended the “My Lamination 4 in 1” Course or the courses of Exclusive Lash & Brow SRL, My Lamination, and My Lamination Brow, is not considered approved by Exclusive Lash & Brow SRL. Any complaints or damages of any nature arising directly or indirectly from improper use cannot be attributed to Exclusive Lash & Brow SRL in any way.
12. Entirety
These General Terms and Conditions of Sale consist of all the clauses contained herein. If one or more provisions are deemed invalid or declared invalid pursuant to law, regulation, or a decision by a competent court, the other provisions shall remain fully valid and effective.
13. Applicable Law and Jurisdiction
These General Terms and Conditions of Sale are governed by Italian law. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the Court of Vicenza.
